These Terms & Conditions apply to the website and vehicle inspection services provided by VERIFY INSPECT PTY LTD ACN 689 836 799, ABN 78 689 836 799, trading as Verifi Inspect.

Please read these Terms carefully before confirming an Inspection.

1. About these Terms

1.1 These Terms govern:

1.2 Submitting an enquiry through the Website, by telephone or by another communication method does not create a Booking and does not require you to make any payment.

1.3 A Booking is confirmed only once:

1.4 When we send you a payment link or otherwise ask you to confirm a Booking, these Terms will be made available to you. By paying the Fee or otherwise confirming a Booking under an approved Dealer or Trade Account, you agree to these Terms.

1.5 Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

2. Definitions

In these Terms:

ACL means the Australian Consumer Law contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth), as amended from time to time.

Booking means a confirmed booking for Inspection Services in accordance with section 1.3.

Business Day means a day other than a Saturday, Sunday or public holiday in Victoria.

Customer, you or your means the individual or organisation requesting or purchasing the Inspection Services.

Dealer or Trade Account means a commercial account approved by Verifi Inspect for a dealer, lender, fleet operator or other business customer.

Fee means the amount payable for the Inspection Services, including GST where applicable.

Inspection means the visual, non-invasive pre-purchase vehicle inspection described in these Terms and the relevant Booking confirmation.

Inspection Report or Report means the digital report prepared following an Inspection.

Inspection Services means the vehicle inspection, coordination, quality assurance and reporting services provided or arranged by Verifi Inspect.

Inspector means a qualified independent third-party inspector engaged through Verifi Inspect's nationwide inspection network to physically perform an Inspection.

Scope Schedule means the Inspection Scope and Limitations Schedule published at verifiinspect.com.au/inspection-scope, as in force at the time the relevant Booking is confirmed, which forms part of these Terms.

Seller means the owner, dealer, seller, custodian or other person responsible for providing access to the Vehicle.

Vehicle means the vehicle identified in the Booking.

Verifi Inspect, we, us or our means VERIFY INSPECT PTY LTD ACN 689 836 799, ABN 78 689 836 799, trading as Verifi Inspect.

Website means verifiinspect.com.au and associated webpages operated by Verifi Inspect.

3. What Verifi Inspect does

3.1 Verifi Inspect arranges and delivers pre-purchase vehicle inspection services throughout Australia.

3.2 The physical Inspection is performed by an Inspector from our nationwide network. Inspectors are independent third-party service providers and are not employees of Verifi Inspect.

3.3 Verifi Inspect coordinates the Inspection process, including communication between the Customer, Seller and Inspector.

3.4 Verifi Inspect also performs quality assurance on the inspection information before releasing the final Report.

3.5 Our quality assurance process may include automated and artificial intelligence-assisted tools to identify inconsistencies, missing information or matters requiring further review.

3.6 AI-assisted tools support, but do not replace, human review. Every Report is reviewed by an authorised Verifi Inspect team member before it is released to the Customer.

3.7 Our use of independent Inspectors does not exclude or reduce any responsibility Verifi Inspect has under the ACL or any other law that cannot lawfully be excluded.

4. Enquiries and Booking process

4.1 You may submit an enquiry:

4.2 An enquiry is only a request for us to investigate whether an Inspection can be arranged.

4.3 No payment is taken and no Booking exists merely because you submit an enquiry.

4.4 After receiving your enquiry, we may contact:

to confirm the Vehicle, location, availability, access and other information needed to arrange the Inspection.

4.5 An Inspection remains subject to availability of a suitable Inspector and reasonable access to the Vehicle.

4.6 Once the necessary details and availability have been confirmed, we will advise you that the Inspection is available and provide payment instructions or, where applicable, confirm the Booking under your Dealer or Trade Account arrangements.

5. Fees and payment

5.1 Unless otherwise quoted to you, the standard Inspection Fee is $299 including GST.

5.2 Dealer and Trade Accounts may be offered separately quoted volume-based or account pricing.

5.3 All prices shown or quoted to Australian Customers are GST-inclusive unless expressly stated otherwise.

5.4 For standard retail Bookings, payment is made through a secure payment link or checkout facility provided by a third-party payment processor, such as Stripe or PayPal, after the Vehicle details and availability have been confirmed.

5.5 Payment confirms the Booking.

5.6 We may change our advertised pricing from time to time. Any change applies only to future Bookings and will not change the Fee for a Booking that has already been paid or otherwise confirmed, unless you agree to the change.

5.7 Payments may be processed by third-party payment providers, including Stripe and PayPal.

5.8 Where payment is made through a third-party payment provider's secure payment facility, your payment information is provided directly to that payment provider. Verifi Inspect does not store your full payment card number or card security code.

5.9 Third-party payment providers are responsible for maintaining the security and payment-card compliance requirements applicable to their payment processing systems.

5.10 Your use of a third-party payment provider may also be subject to that provider's applicable terms, conditions and privacy arrangements.

6. Dealer and Trade Accounts

6.1 Verifi Inspect may offer approved commercial Customers a Dealer or Trade Account.

6.2 Pricing for a Dealer or Trade Account may be based on expected volume, service requirements, geographic coverage or other agreed commercial factors.

6.3 Dealer or Trade Accounts may use centralised billing or invoicing arrangements agreed with Verifi Inspect rather than individual payment links for each Inspection.

6.4 Account pricing and payment arrangements will be confirmed separately with the relevant Customer.

6.5 Unless expressly agreed otherwise in writing, these Terms apply to each Inspection booked through a Dealer or Trade Account.

6.6 If there is an inconsistency between these Terms and a separately agreed written Dealer or Trade Account arrangement, the specifically negotiated account term will apply to the extent of the inconsistency.

6.7 Nothing in a Dealer or Trade Account arrangement excludes any protection under the ACL, including protections applying to standard form small business contracts, where those protections apply.

6.8 A Dealer or Trade Account Customer may provide a Report to a prospective purchaser, financier or insurer of the Vehicle, provided that:

6.9 Subject to sections 15 and 16.1, the total aggregate liability of Verifi Inspect to a Dealer or Trade Account Customer for all claims arising in any 12-month period is limited to the greater of the total amounts paid by that Customer to Verifi Inspect in that period and $20,000.

7. Customer information and responsibilities

7.1 You must take reasonable care to provide us with accurate and complete information relevant to the Inspection.

7.2 This includes, where applicable:

7.3 You must promptly tell us if you become aware that information you provided is incorrect or has changed.

7.4 We may rely on information reasonably provided by you or the Seller when coordinating the Inspection.

7.5 If materially incorrect information supplied by you causes an Inspector to attend the wrong location, inspect the wrong Vehicle or be unable to carry out the Inspection, we will work with you to reschedule where reasonably possible.

7.6 If reasonable third-party costs have already been committed or incurred solely because of materially incorrect information supplied by you, we may ask you to pay those reasonable costs before arranging another attendance. Any amount payable under this section is capped at $75 including GST and will not exceed the reasonable costs actually committed or incurred.

7.7 We will tell you about any additional amount before requiring payment.

7.8 Nothing in this section limits your rights where the failure to complete the Inspection was caused by Verifi Inspect, an Inspector or another matter for which Verifi Inspect is legally responsible.

7.9 You indemnify Verifi Inspect against loss, damage, cost or expense (including reasonable legal costs) suffered or incurred by Verifi Inspect arising from:

7.10 The indemnity in section 7.9 is reduced proportionately to the extent that the relevant loss, damage, cost or expense was caused or contributed to by Verifi Inspect's own negligence or breach of these Terms.

8. Inspection timing

8.1 We aim to arrange Inspections as quickly as reasonably possible after a Booking is confirmed.

8.2 Timing depends on matters including:

8.3 The digital Report is typically delivered by email within 24 hours after the Inspection has been completed.

8.4 Depending on Seller availability, location and other circumstances, we generally aim to complete the Inspection process and provide the Report within 72 hours after Booking confirmation.

8.5 The timeframes in sections 8.3 and 8.4 are expected service timeframes rather than absolute guarantees unless we expressly agree otherwise with you.

8.6 Where the ACL applies and no particular time has been agreed for the supply of services, any applicable consumer guarantee requiring services to be supplied within a reasonable time continues to apply.

8.7 We will take reasonable steps to notify you of any material delay that becomes known to us.

9. Nature and scope of the Inspection

This section is important. Please read it before purchasing an Inspection.

9.1 The Inspection is a visual and non-invasive assessment of the Vehicle's condition at the date and time of the Inspection.

9.2 The Inspector assesses components and areas that are reasonably visible and accessible at the time of the Inspection.

9.3 Unless expressly included in a separately described service, the Inspection does not involve dismantling, disassembling, removing or materially disturbing Vehicle components.

9.4 For example, an Inspector is not required to dismantle an engine, transmission, differential, interior trim, body panel or other component to identify a fault that is not otherwise reasonably observable.

9.5 The Inspection may include a road test where it is reasonably possible, safe and lawful to do so.

9.6 A road test may not be performed where, for example:

9.7 An Inspector is not required to drive a Vehicle that they reasonably consider unsafe or unroadworthy.

9.8 Where a planned aspect of the Inspection cannot reasonably be completed, that limitation should, where reasonably practicable, be identified in the Report.

9.9 The Report records observations made at the time of the Inspection. Vehicle condition may change after the Inspection.

9.10 The Inspection is carried out on the terms of, and subject to the limitations set out in, the Scope Schedule, which forms part of these Terms. The Scope Schedule is available at verifiinspect.com.au/inspection-scope/ and is provided with each Report.

9.11 You should read the Scope Schedule before confirming a Booking. If the Scope Schedule is inconsistent with a service inclusion that we have expressly agreed with you in writing, the express inclusion applies to that Booking.

10. What the Inspection is not

10.1 An Inspection and Report are intended to provide useful information to assist you when considering the purchase of a Vehicle.

10.2 They are not:

10.3 Some faults may be intermittent, concealed, latent or incapable of being identified through a visual, non-invasive inspection.

10.4 In particular, the Inspection may not identify a fault that could only reasonably be discovered by:

10.5 Nothing in this section reduces the standard of due care and skill that Verifi Inspect or an Inspector is required to exercise under applicable law.

11. Access and Seller cooperation

11.1 The Inspection depends on reasonable access to the Vehicle being provided by the Seller or another person controlling the Vehicle.

11.2 We will take reasonable steps to coordinate access with the Seller.

11.3 A Seller is not a party under our control, and we cannot require a Seller to:

11.4 If access is restricted, the Inspector will assess the Vehicle to the extent reasonably possible.

11.5 If a restriction materially affects the Inspection, we will identify that restriction in the Report where reasonably practicable.

11.6 We are not responsible for information that a Seller deliberately conceals or misrepresents where the matter could not reasonably have been identified through an Inspection performed with due care and skill.

11.7 Nothing in section 11.6 limits our responsibility for a matter that should reasonably have been identified within the agreed scope of an Inspection performed with due care and skill.

11.8 You must ensure, or ask the Seller to ensure, that the Vehicle's owner or lawful custodian consents to the Vehicle being opened, started, operated and, where applicable, road tested by the Inspector, and that the Vehicle is registered and insured where a road test is to be carried out.

11.9 If the Vehicle is damaged during an Inspection, please notify us within 24 hours of becoming aware of the damage and, where reasonably practicable, before the damage is repaired, so that the matter can be investigated. Verifi Inspect is not responsible for damage arising from a pre-existing fault, defect or condition of the Vehicle, or to the extent that the damage was caused by the Vehicle not being registered, insured or in a roadworthy condition, except where the damage was caused by a failure by Verifi Inspect or the Inspector to exercise due care and skill.

12. Inspection Reports

12.1 After the Inspection and our quality assurance process are completed, the Report will be sent electronically to the email address supplied by you or another address agreed with us.

12.2 The Report should be read as a whole.

12.3 Photographs, comments, observations and condition assessments should be considered together and in the context of any limitations identified in the Report.

12.4 Where you believe information in a Report is unclear or may contain an error, please contact us promptly so that we can review the matter.

12.5 We may correct an administrative, typographical or factual error in a Report after issue where appropriate.

12.6 We will not materially alter an Inspector's findings merely because a Customer, Seller or another person disagrees with them.

12.7 If further information becomes available that reasonably justifies a correction or clarification, we may issue an amended Report and will clearly identify it as an amended version.

12.8 Report finalisation and records

(a) Information recorded by the Inspector during an Inspection is submitted through Verifi Inspect's platform and reviewed by Verifi Inspect before a Report is issued. That review addresses presentation, internal consistency, completeness of the record and quality assurance. It does not involve any further or independent physical inspection of the Vehicle by Verifi Inspect, and Verifi Inspect does not verify the Inspector's observations by physical examination of the Vehicle.

(b) Verifi Inspect retains the information as originally submitted by the Inspector, together with a record of any amendment made before the Report was issued. Both parties agree that those records are the record of the Inspection and of the Report as issued, and may be relied upon by either party.

12.9 Reliance

(a) Each Report is prepared solely for the Customer, for the purpose notified to Verifi Inspect at the time of booking.

(b) Except as permitted under sections 6.8 or 18, or as agreed with us in writing, no person other than the Customer may rely on a Report, and Verifi Inspect does not accept a duty of care or liability to any person other than the Customer in respect of a Report or its contents.

(c) Any copy of a Report provided to another person under sections 6.8 or 18 must be provided in full, including all limitations and the Scope Schedule.

13. Your purchase decision

13.1 The Inspection is intended to assist you in making an informed decision.

13.2 The final decision whether to purchase, finance, sell, retain or otherwise deal with a Vehicle remains yours.

13.3 Depending on the Vehicle and your circumstances, you may also wish to obtain other information before purchasing, such as:

13.4 Section 13 does not remove any legal responsibility Verifi Inspect has for the Inspection Services we supply.

14. Cancellations, transfers and refunds

14.1 Before payment

You may cancel an enquiry at any time before payment without charge. Because an enquiry is not a Booking, nothing is payable and there is nothing to refund.

14.2 If the Inspection cannot proceed

If, after you have paid, the Inspection cannot reasonably proceed because, for example:

No cancellation charge applies in the circumstances described in this section 14.2.

14.3 Customer change-of-mind cancellations

If you change your mind after payment:

Any deduction under sections 14.3(c) or 14.3(d) is capped at $75 including GST and will never exceed the reasonable costs actually committed or incurred by Verifi Inspect as a result of the late cancellation.

14.4 Transfers requested by the Customer

Before the cancellation cut-off in section 14.3, you may ask us to transfer your Booking to another Vehicle instead of cancelling. We will reasonably accommodate the request subject to availability and any genuine difference in the price of the replacement Inspection. Where a late transfer causes reasonable non-recoverable Inspector or travel costs, section 14.3 may apply to those costs.

14.5 Once an Inspection has commenced

If an Inspection has already commenced and you cancel for reasons unrelated to any failure by Verifi Inspect to comply with these Terms or applicable law, you may be required to pay a reasonable amount for the services properly provided up to the time of cancellation.

14.6 Refund processing

Approved refunds will generally be returned using the original payment method or through the payment provider used for the transaction, where reasonably possible. The time taken for refunded funds to become available to you after we process the refund may depend on the relevant payment provider, including Stripe or PayPal, your bank or your card issuer.

14.7 Australian Consumer Law rights

The cancellation and refund arrangements in this section apply in addition to your rights under the ACL. Nothing in this section limits any right you may have to a refund, cancellation, re-supply, compensation or other remedy because the Inspection Services fail to comply with an applicable consumer guarantee.

15. Consumer guarantees

15.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

15.2 Where the ACL applies, these may include guarantees that services will:

15.3 If an Inspection Service does not comply with an applicable consumer guarantee, you may be entitled to remedies under the ACL depending on the nature and seriousness of the failure.

15.4 Those remedies may include having the service supplied again, cancellation, a refund or compensation for reasonably foreseeable loss or damage, depending on the circumstances and applicable law.

15.5 Nothing in these Terms is intended to represent that your ACL rights are limited to the remedies expressly described in these Terms.

16. Liability

16.1 Non-excludable rights

Nothing in these Terms excludes, restricts or modifies:

where doing so would be unlawful.

16.2 Section 64A of the Australian Consumer Law

This section does not apply where section 64A does not permit the limitation or where reliance on it would not be fair or reasonable.

16.3 Losses outside our responsibility

To the maximum extent permitted by law, Verifi Inspect is not responsible for loss or damage to the extent that the loss or damage:

(a) Subject to sections 15, 16.1 and 16.2, and to the maximum extent permitted by law, the total aggregate liability of Verifi Inspect to you arising out of or in connection with these Terms, the Inspection Services or a Report, whether in contract, in tort (including negligence), under statute, in equity or otherwise, is limited, at Verifi Inspect's election, to:

Subject to sections 15 and 16.1, Verifi Inspect is not liable to you for any indirect or consequential loss, or for any loss of profit, loss of revenue, loss of business opportunity, loss of anticipated savings, loss of data, loss of reputation, or costs of finance, storage, transport, accommodation or alternative transport, however arising.

16.6 No blanket exclusion

Nothing in sections 9, 10, 11, 13 or 16 is intended to excuse Verifi Inspect or an Inspector from exercising the standard of care and skill required by law.

17. Independent Inspectors

17.1 Verifi Inspect uses a nationwide network of independent third-party Inspectors.

17.2 Inspectors are not employees of Verifi Inspect merely because Verifi Inspect coordinates their attendance or includes their inspection findings in a Report.

17.3 Verifi Inspect is responsible for coordinating the overall Inspection Service and carrying out the quality assurance functions described in these Terms.

17.4 Nothing in this section transfers to you a responsibility that the law places on Verifi Inspect.

17.5 You do not need to separately engage or pay the Inspector unless we expressly agree otherwise with you in writing.

18. Intellectual property and use of Reports

18.1 Unless otherwise stated, Verifi Inspect owns or is licensed to use the intellectual property contained in:

18.2 Your payment for an Inspection does not transfer ownership of that intellectual property to you.

18.3 Consumer and private Customers

A Customer who commissions an Inspection for their own vehicle purchase decision may use the Report for that purpose. You may also privately provide the Report to people reasonably assisting with that decision, such as:

18.4 Commercial Customers

Dealers, lenders, fleet operators and other commercial Customers may use Reports internally for legitimate business purposes connected with assessing, purchasing, selling, financing, managing or dealing with Vehicles.

18.5 Restrictions

Unless we agree otherwise in writing, you must not:

18.6 Nothing in this section prevents a Customer from using a Report where reasonably necessary to exercise a legal right, make a complaint, obtain professional advice or participate in legal or regulatory proceedings.

19. Privacy

19.1 We handle personal information in accordance with applicable privacy law and our Privacy Policy.

19.2 Our Privacy Policy explains how we collect, use, store and disclose personal information.

19.3 The Privacy Policy is available at: verifiinspect.com.au/privacy

19.4 When arranging an Inspection, we may need to use and disclose relevant information between you, the Seller, the Inspector, our service providers and our authorised personnel for purposes connected with arranging, completing, reviewing and delivering the Inspection.

19.5 You should only provide us with personal information about another person where you are reasonably entitled to provide that information.

20. Communications and marketing

20.1 Service communications

By making an enquiry or Booking, you agree that we may contact you using the contact information you provide where reasonably necessary to:

20.2 Operational communications are separate from marketing communications and may be necessary for us to provide the service you requested.

20.3 Marketing

We may send you commercial electronic marketing communications where:

20.4 Marketing communications will identify Verifi Inspect and provide a way to unsubscribe.

20.5 You may unsubscribe from electronic marketing communications at any time using the unsubscribe facility contained in the message or by contacting us.

20.6 We will action unsubscribe requests within the period required by the Spam Act 2003 (Cth).

20.7 Unsubscribing from marketing does not prevent us from sending communications reasonably necessary to manage an existing enquiry, Booking, Inspection, payment, Report or other service requested by you.

21. Website use

21.1 You may use the Website for lawful purposes connected with learning about, enquiring about or obtaining Verifi Inspect's services.

21.2 You must not knowingly:

21.3 We may take reasonable steps to restrict access to the Website where reasonably necessary to protect security, prevent unlawful activity or prevent material interference with our systems.

21.4 Restricting Website access does not remove any rights you already have in relation to a paid Inspection or under applicable law.

22. Website availability and information

22.1 We take reasonable steps to keep Website information accurate and available.

22.2 The Website may occasionally be unavailable because of maintenance, technical issues or circumstances outside our reasonable control.

22.3 General information on the Website is not a substitute for the specific Inspection Report relating to a particular Vehicle.

22.4 If a specific written quote or Booking confirmation is inconsistent with general Website information, the specific quote or Booking confirmation will apply to that Booking, subject to applicable law.

23. Events outside reasonable control

23.1 An Inspection may be affected by circumstances outside our reasonable control, such as severe weather, natural disasters, road closures, illness, accidents, telecommunications failures or other unexpected events.

23.2 Where such an event causes a delay, we will take reasonable steps to minimise the effect and arrange a new Inspection time where practicable.

23.3 If the Inspection cannot reasonably be provided, you may choose a refund or transfer in accordance with section 14.2.

23.4 Nothing in this section limits any rights or remedies available under the ACL.

24. Complaints and report queries

24.1 We encourage you to contact us if you have a question or concern regarding an Inspection or Report.

24.3 Please provide reasonable details of the issue, including the relevant Vehicle and Inspection where possible.

24.4 We will review the matter and respond within a reasonable time.

24.5 Nothing in these Terms prevents you from exercising any right to contact a consumer protection regulator, tribunal, court or other authority.

24.6 If you consider that a Report is inaccurate or incomplete, please notify us in writing as soon as reasonably practicable, and where possible within 30 days after you become aware of the matter, identifying the Vehicle, the Booking, the Report, the specific item said to have been missed or incorrectly recorded, and any supporting evidence available to you. This section is a notification request, not a time bar: it does not limit any right or remedy you have under the ACL, nor any applicable statutory limitation period. Delay in notification may, however, affect our ability to investigate the matter.

24.7 Where you notify a concern under section 24.6, please, so far as reasonably practicable:

24.8 Section 24.7 does not require you to delay any repair that is reasonably necessary for the safety of any person, to comply with any law, or to make the Vehicle roadworthy, nor to keep the Vehicle off the road for an unreasonable period. Nothing in section 24.7 limits any right or remedy you have under the ACL. Where a reasonable opportunity to inspect is not provided, Verifi Inspect may take that into account in assessing the claim, to the extent that it has materially prejudiced Verifi Inspect's ability to assess it.

25. Changes to these Terms

25.1 We may update these Terms from time to time to reflect changes to:

25.3 Changes to these Terms apply prospectively.

25.4 Unless you agree otherwise, a material change will not retrospectively alter the Terms applying to an Inspection that was already paid for or otherwise confirmed before the change took effect.

25.5 Where a change is required by law and must apply to an existing arrangement, we will provide any notice required by law.

25.6 For ongoing Dealer or Trade Account arrangements, we will provide reasonable notice of a material change that adversely affects the Customer before applying that change to future Bookings.

25.7 Nothing in this section gives Verifi Inspect an unrestricted right to change the price or fundamental nature of a Booking after it has been confirmed.

26. Assignment

26.1 Neither party may assign its rights or obligations under a confirmed Booking without the consent of the other party, where consent is required by law.

26.2 We may assign or transfer our rights and obligations as part of a genuine corporate restructure, merger or sale of our business provided that:

27.2 We may send notices relating to a Booking to the email address, telephone number or other contact details you have supplied to us.

27.3 You should notify us if your contact information changes while a matter remains ongoing.

28. Severability

28.1 If any provision of these Terms is found to be invalid, unlawful, void or unenforceable, that provision will be read down to the minimum extent necessary where legally possible.

28.2 If it cannot be read down, it will be severed.

28.3 The remaining provisions will continue to operate to the extent permitted by law.

28.4 In particular, if a term is void because it is an unfair contract term under the ACL, the remainder of these Terms continues to apply to the extent it can operate without that term.

29.1 Subject to applicable law, the agreement for an Inspection consists of:

30. No waiver

30.1 If either party does not immediately enforce a right under these Terms, that does not automatically mean that the party has waived the right.

30.2 A waiver of a right on one occasion does not automatically waive that right on another occasion.

31. Governing law

31.1 These Terms are governed by the laws of Victoria, Australia.

31.2 The parties may bring proceedings in any court or tribunal that has jurisdiction to hear the matter.

31.3 Nothing in this section prevents a consumer or small business from relying on any mandatory right concerning jurisdiction or dispute resolution available under applicable law.
